• Securing HOA approvals where applicable.

Tri-State Fence & Deck may assist with permit applications and utility-marking coordination, but approval decisions remain subject to governmental and HOA authorities.

5. Scheduling and Project Timelines

Estimated start and completion dates are approximate and may be affected by:

• Weather conditions
• Permit approval delays
• Material shortages
• Utility marking schedules
• Site conditions
• Customer-requested changes

We are not liable for delays beyond our reasonable control.

6. Deposits and Payments

Unless otherwise specified in a written contract:

• A deposit may be required before scheduling work.
• Final payment is due according to the terms stated in the signed contract.
• Failure to make timely payments may result in project delays, suspension of work, or collection actions permitted by law.

7. Change Orders

Any modifications to the original project scope, materials, dimensions, design, or installation requirements may require a written Change Order and additional charges.

No changes will be binding unless approved by both parties.

8. Warranties

Tri-State Fence & Deck provides workmanship warranties as specified in the customer contract. Manufacturer warranties apply only to eligible products and are governed by the manufacturer's terms.

Warranty coverage does not include:

• Acts of nature
• Storm damage
• Flooding
• Ground movement
• Improper use
• Customer modifications
• Damage caused by third parties

9. Limitation of Liability

To the maximum extent permitted by law, Tri-State Fence & Deck shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from:

• Use of the website
• Service delays
• Project interruptions
• Loss of profits
• Property conditions outside our control

Our total liability shall not exceed the amount paid by the customer for the applicable service.
